According to the report, the US Court of International Trade (CIT) ruled that Trump had no right to increase the Section 232 tariff on Turkish steel from 25% to 50%, but the US Court of Appeals for the Federal Circuit reversed this decision.
Based on national security considerations, the court believed that the president could use Section 232 to exercise his powers, including adjusting tariffs.
In addition, the court also ruled that there was a reasonable basis for increasing the import tariffs on Turkish steel. The reason was that the US Department of Commerce (USDOC) identified Turkey as the primary source of imported steel in the preliminary report and suggested that tariff increases should be considered.
